Privacy Policy for Aliva AS

1. General

Aliva AS, org. no. 925 021 482, is the data controller for personal data we collect when you  shop with us or use our services. We process your information in accordance with the  General Data Protection Regulation (GDPR) and Norwegian data protection legislation.

2. What information we collect

We may collect the following information about you: 

  1. Identity and contact information 

– Name 

– Address 

– Phone number 

– Email address 

  1. Payment information 

– Card information and payment history (processed by Kustom, not stored by us) 

  1. Order and delivery information 

– Order details 

– Delivery address 

– Purchase and subscription data 

  1. Health and usage information 

– Information about dry mouth or other information you provide to receive product  recommendations or customer support. We never request medical diagnoses or sensitive  health information that is not relevant to the use of the product. Such information is only  processed if you approve (jf. GDPR art.9).

3. Purpose of processing

We use your information for the following purposes: 

  1. Execution of purchases and delivery of products. 
  2. Administration of subscriptions and dispatch of mouthpieces. 
  3. Invoicing and payment through Klarna. 
  4. Customer service and complaints handling. 
  5. Compliance with legal obligations (e.g., accounting legislation). 
  6. Improvement of our services (statistics and analysis – anonymized data only).

4. Legal basis for processing

– Contract: To deliver the product and manage your subscription. 

– Consent: For any marketing communications and processing of health-related  information you voluntarily provide. 

– Legal obligation: To comply with statutory requirements.

5. Sharing of information

We do not share personal data with third parties unless: 

– It is necessary to deliver the service (e.g., carrier and supplier of payment solutions). – We have your consent. 

– We are legally required to disclose the information.

6. Data retention

– Customer data: Stored as long as the subscription is active and up to 3 years after the last  delivery. 

– Transaction data: Stored for 5 years in accordance with the Accounting Act. – Health information: Deleted or anonymized when no longer necessary for the purpose for  which it was collected.

7. Security

We use technical and organizational measures to protect your personal information against  loss, misuse, and unauthorized access. Only authorized personnel have access to the  information, and all are subject to confidentiality obligations.

8. Your rights

You have the right to: 

– Access the information we hold about you. 

– Have information corrected or deleted. 

– Object to or restrict processing. 

– Receive your data in a structured format (data portability). 

– Withdraw consent. 

To exercise your rights, please contact us at post@aliva.no. You may also file a complaint  with the Norwegian Data Protection Authority (Datatilsynet) if you believe we are processing  your information unlawfully.

9. Use of Cookies

We use Cookiebot to manage cookie

Our website is regularly scanned, and an automatically updated declaration of all  cookies in use is provided. 

  • Cookies are categorized as necessary, preferences, statistics, and marketing. 
  • You can change or withdraw your consent at any time through the cookie banner or  via our cookie declaration 

Only strictly necessary cookies are set without consent. All other types require your  explicit consent in accordance with the Norwegian Electronic Communications Act  and GDPR.

10. Changes to this Privacy Policy

We may update this policy as necessary. The updated version will always be published on  our website with a new date.

11. Termination

After the binding period, the subscription may be terminated with 1 month’s written  notice. 

The termination takes effect from the next subscription period after the notice  period ends. 

The device must be returned within 14 days after the subscription ends.

12.Privacy

We process personal data in accordance with applicable law and our privacy policy. Payment information is handled by Kustom and is not stored by Aliva AS.

13. Dispute Resolution

Disputes should be resolved amicably. 

If agreement is not reached, the customer may bring the case before the Norwegian  Consumer Authority or the Consumer Complaints Board.

Norwegian law applies to the agreement.

14. Medical Disclaimer

The product, Aliva Oral Hydration System, is a medical aid for the relief of dry mouth  and should be used according to the user manual that follows with the product. 

The product is not intended to replace consultation, diagnosis, or treatment  provided by a doctor or other qualified health personnel. 

The customer should consult health professionals before use if they have medical  conditions or health-related questions. 

Aliva AS is not responsible for injuries or health consequences resulting from  misuse, failure to follow instructions, or use contrary to health professional  recommendations.
