Terms and Conditions of Sale and Subscription – Aliva AS

1. General
These terms apply to subscription of the Aliva Oral Hydration System as well as purchases of other products offered in our online store. The terms also apply to future products offered by Aliva AS, org.no. 925 021 482. By placing an order, you confirm that you have read and accepted these terms and our privacy policy.
2. Product and Subscription
The Aliva Oral Hydration System is a medical device consisting of a pump and a fluid container with associated mouthpieces.
When subscribing to 2 mouthpieces per month, the customer borrows the device free of charge for the duration of the subscription period.
The subscription is personal and cannot be transferred without written consent from Aliva AS.
Additionally, the online store may offer other products for one-time purchase, which are not part of the subscription scheme.
3. Price
The prices listed in the online store is included norwegian VAT.
Information about the total cost the buyer must pay, including all taxes (VAT, customs, etc.) and delivery charges (shipping, postage, invoice fees, packaging, etc), is provided in the checkout process before the order is placed.
4. Trial Period and Binding Period for Aliva Oral Hydration System
The customer has a 14-day trial period from the delivery date (registered receipt). If the customer wishes to cancel within the trial period, the device and unused mouthpieces must be returned according to section 8.
The subscription has a binding period of 3 months from the order date.
Termination before the end of the binding period will result in the customer being invoiced for the remaining binding period.
5. Ordering and Payment Terms
Orders are placed through our online store using Kustom Checkout as the payment solution for both subscriptions and one-time purchases.
The customer must enter a valid payment card when ordering. This applies to both one-time purchases and subscriptions.
The fixed monthly amount is automatically deducted from the registered payment card on the due date.
The customer accepts automatic payment upon entering into the subscription.
If the customer returns the Aliva Oral Hydration System within 14 days in accordance with section 4, any charged amount will be refunded to the registered payment card.
Payment default may result in suspension of the subscription and termination of the agreement.
6. Delivery
Delivery is made to the pick-up point chosen by the customer in our online store.
Normal delivery time is 2-4 working days after the order is placed. Delays may occur due to issues with the carrier, weather conditions, or other unforeseen events.
For delivery to Svalbard, customers must contact our customer service for special arrangements.
It is not possible for customers outside Norway to place orders in our online store. The risk for the product transfers to the customer upon delivery.
7. Customer Responsibilities for Subscription
The customer must use the system according to the user manual and must not tamper with or modify the device.
The device is the property of Aliva AS and must be returned in good condition upon termination of the subscription.
The customer is responsible for loss or damage due to negligent use.
8. Right of Withdrawal
According to the Right of Withdrawal Act, the customer has a 14-day right of withdrawal from receipt of the first delivery.
To use the right of withdrawal, the customer fills out the return form and the withdrawal form found on “My Page” in the online store and in the original order confirmation email.
Free return applies when using the right of withdrawal.
Upon using the right of withdrawal, the customer will receive an email with a QR code and a link to a return label that can be printed and attached to the package. If using the QR code, it must be shown at the Post office, which will print the label. The customer does not need to print it themselves. The return package is delivered to the drop-off point and sent back to Aliva AS at no cost to the customer.
The product must be returned in its original packaging and in the same condition as received, and in saleable condition.
If the product appears used and not in saleable condition, it is considered used and the right of withdrawal lapses fully or partially.
9. Complaints
Complaints follow the provisions of the Consumer Purchases Act.
Complaints must be reported within a reasonable time after a defect is discovered and no later than 2 years after receipt of the product.
In case of complaint, we offer repair or replacement depending on the situation.
10.Price Changes
Aliva AS may adjust the subscription price with 30 days’ notice.
Price changes do not apply during the binding period.
11. Termination
After the binding period, the subscription may be terminated with 1 month’s written notice.
The termination takes effect from the next subscription period after the notice period ends.
The device must be returned within 14 days after the subscription ends.
Return address: Aliva AS, Rigedalen 41, 4623 Kristiansand. Mark the return with your order number.
12.Privacy
We process personal data in accordance with applicable law and our privacy policy. Payment information is handled by Kustom and is not stored by Aliva AS.
13. Dispute Resolution
Disputes should be resolved amicably.
If agreement is not reached, the customer may bring the case before the Norwegian Consumer Authority or the Consumer Complaints Board.
Norwegian law applies to the agreement.
14. Medical Disclaimer
The product, Aliva Oral Hydration System, is a medical aid for the relief of dry mouth and should be used according to the user manual that follows with the product.
The product is not intended to replace consultation, diagnosis, or treatment provided by a doctor or other qualified health personnel.
The customer should consult health professionals before use if they have medical conditions or health-related questions.
Aliva AS is not responsible for injuries or health consequences resulting from misuse, failure to follow instructions, or use contrary to health professional recommendations.
